By registering to participate in the EuroGames 2021, you accept the following Terms and Conditions:
The EuroGames 2021 are organized by Happy Copenhagen, a non-profit organisation registered in Copenhagen, Denmark (hereinafter referred to “HC”).
EuroGames® is licensed by the European Gay & Lesbian Sport Federation (EGLSF).
1. Disclosure of personal Information
I understand that as part of the registration process of the EuroGames 2021, personal information will be collected by HC and stored in accordance with Danish legislation. I accept the collection, use and disclosure of my personal information for the purpose of enabling my participation in the sports, conference and cultural program of the EuroGames 2021 and for the purpose of receiving information related to my participation in this event from HC in the form of electronic newsletters, promotional flyers and other communication media.
I give my consent that HC may disclose my personal information to any third parties that are involved in the organisation, on behalf of HC, of the EuroGames 2021 and to the European Gay & Lesbian Sport Federation for the purposes of promoting the EuroGames 2021 and to promote future events of EGLSF’s member associations.
2. Age Policy
The age limit for participation in the EuroGames in 2021 is 18 years. Accordingly, participants must be 18 years old or older by 17 August 2021.
3. Gender Policy
HC affirms and supports the rights of athletes to compete as their true selves and to compete in the gender category that accords with their gender identity.
Male categories are open to all who identify as male, and female categories open to all who identify as female.
We recognize that a binary definition of gender excludes people who are non-binary, and so in sports with different gender categories, we will have a third category for non-binary athletes.
During the registration process, athletes are asked about their sexual and gender identity, and whether their gender identity is different to the gender they were assigned at birth. Please note that these are optional questions. The data helps us monitor inclusion, diversity and representation at the EuroGames in 2021. Furthermore, we will use the data to create a push for greater inclusion in sports by proving that it is indeed possible.
4. Health and Insurance
I declare that I am in a physically fit and healthy state which is required for participation in events of the EuroGames in 2021 for which I am registering, and that I am not aware of any serious medical condition that would prevent me participating in these physical activities. For clarification, it is agreed that having been diagnosed as HIV positive is not considered a “serious medical condition” for the purposes of this clause.
If I sustain an injury or illness while participating in any role in the EuroGames 2021, I hereby authorise any medical or health personnel to perform and administer first aid medical treatment as deemed necessary and to seek more specialised medical attention at hospitals and health care institutions if deemed necessary by any first aid and medical staff or contractors of HC.
I accept that it is my responsibility to organise my own travel insurance and personal accident insurance to cover my property and myself for the whole period of the EuroGames in 2021. I agree that I have hereby been advised to acquire adequate personal accident and health care insurance as a participant in any role in the EuroGames in 2021.
5. Liability
I acknowledge that I am fully aware of the risks and hazards inherent to participation in the different events of the EuroGames in 2021. I acknowledge and agree that I have elected to voluntarily enter this agreement and to assume all risks of loss, damage and injury, including death, that I may sustain as a consequence of my participation in any of the sports or other events that I have registered for. I hereby fully release HC and all of its affiliated companies, sponsors, servants, agents, officers, directors, members and employees from any claims, actions, suits or demands of whichever nature arising out of or related in any way to my participation in the events of the EuroGames 2021, including any loss, damage, injury or death sustained by any third party as a result, directly or indirectly, of my participation in the event. I hereby fully indemnify HC and all of its affiliated companies, sponsors, servants, agents, officers, directors, members and employees against all expenses, losses, damages and costs that they may incur as a result of my participation in the event.
6. Rules and Regulations
I agree to abide by the rules and regulations of the EuroGames 2021 events as determined by HC and governing bodies for sport and cultural events, including all written and verbal instructions given by HC designated officials and event managers.
Applicable rules and regulations include – but are not limited to:
- The Danish national anti-doping rules (”Dopingreglement for motionsidræt under Danmarks Idrætsforbund (DIF), Dansk Firmaidrætsforbund (Firmaidrætten) og DGI”)
- Happy Copenhagen Privacy Policy
I agree that any failure to comply with the official instructions, rules and regulations of HC or governing bodies for sports, conference and culture events may result in immediate disqualification from events or from the games.
I accept that the decisions of HC and EuroGames in 2021 tournament officials are final.
HC reserves the right to have designated officials reclassify sports, cultural event and conference participants where the registrant has self-selected a grade, level, category, division or other classification. HC reserves the right to combine or eliminate grades, levels, rounds, event lengths, categories, divisions, or other classifications if deemed necessary at HC’s complete and sole discretion.
I am aware that some venues or locations may have restricted accessibility or restrictions to serve special needs. HC is committed to make sports, politics and culture accessible for everyone. Denmark has legislation that prohibits any kind of discrimination based on special needs or disabilities. The EuroGames 2021 will follow local legislation and aim for a fully accessible event independent of any special needs or disabilities.
7. Refund Policy
Venues, competition days and schedules of events may be changed or cancelled at HC’s absolute discretion, after which HC may decide to provide a refund of participation fees. In the event that HC cancels the entire event, or parts of the event, for any reason whatsoever, including in case of COVID-19 restrictions or limitations, I agree that I will have no claim or take no action against HC in respect of any loss, damage or expenses incurred by me as a result of such cancellation, and I accept and agree that I will only be entitled to a refund of the registration fee. In the event where I as a participant can no longer take part in the upcoming event, I accept and agree that no claim or action will be taken against HC regarding pay back of the registration fee. In the event of cancellation due to force majeure, I agree that I will not be entitled to any refund or compensation.
8. Outreach
I accept that some participants of the EuroGames 2021 may have their registration fee deducted or removed or gain other financial benefits as part of the Outreach programme. The criteria for gaining such benefits are based upon HC’s Outreach Policy, which can be received from HC and will be provided to all who apply for the Outreach programme.
9. Trademarks and Branding
I agree not to make any unauthorised use of the logo or trademarks, including “EuroGames”, “EuroGames 2021”, “EGLSF” or any variation on these, on personal or team uniforms/clothing, merchandise, or promotional material and to abide by HC’s policies governing the use of logos and trade names.
I agree not to act in a way that would harm or compete with or devalue HC and European Gay and Lesbian Sport Federation, EGLSF sponsors’ rights regarding branding potential, logo rights, exclusive presence, etc. at venues where events are being held. If at any time during the event, officials designated by HC determine, at their sole discretion, that my actions may result in the devaluation of said sponsor rights or competes with the event sponsors, I will be required to immediately cease such action, including the removal of any uniforms, signs or other items that compete with sponsor or potentially devalues such sponsorship.
10. Promotional Material
I hereby grant HC the unconditional right to use, at its discretion, photographic pictures of myself in any form of media, art, advertising, trade, visual documentary, promotional material, merchandise or film coverage of any kind without compensation to me or approval by me. I will not make any unauthorised reproductions or copies of the EuroGames 2021 logo or likenesses without written permission from HC.
11. Applicable Law
Any dispute arising out of or in connection with the EuroGames 2021, including any disputes regarding the existence, validity or termination thereof, will be subject to Danish law and will be resolved by the Copenhagen City Court, Denmark.
