This presentation explores the shifting position of the European Court of Human Rights as it attempts to appease both European states and LGBTQI+ individuals by finding same-sex relationships must be recognised by a registered partnership instead of marriage. The Court’s new middle ground provides some – but not full – protection for same-sex couples. It appears the Court is adopting a ‘wait and see’ approach on same-sex marriage given its acceptance of the registered partnership route. Thus, this contribution addresses the question of whether strategic litigation should now take a different approach to the right to marry for same-sex couples.
